Terms of service

These terms apply to sundayscycles.com and to the products and services we provide at our shop at 2411 Main St, Santa Monica, CA 90405. In these terms, "we", "us" and "Sundays" mean Sundays Cycles, and "you" means you, the customer. By using this website, buying from us, or having work done at the shop, you agree to what follows.

1. This website does not take payment

Sundays does not sell through an automated checkout. When you add items to the cart and send a request, you are asking us to confirm availability and price. That request is not an order, an offer, or a binding contract, and no money is taken at that point.

A sale exists only once we have confirmed it with you in writing and you have paid, or paid a deposit. Until then either side is free to walk away. We may decline or cancel a request for any lawful reason, including stock we no longer have, pricing errors, or an order we cannot fulfill properly.

2. Prices and availability

Prices are in US dollars and can change without notice. Some products show "contact for pricing" because the brand's terms prevent us from advertising a price, not because we are hiding anything. Stock shown on the site is our best information at the time and is not a guarantee that an item is on the floor.

We do our best to be accurate, but errors happen. If a price or a specification is wrong, we are not obliged to honor it. We will tell you before taking payment, and if you have already paid, you can have a full refund or the corrected item, whichever you prefer.

A written quote from us is valid for 14 days unless it says otherwise. After that we may need to requote, because component pricing and availability move.

3. Product information

Specifications, geometry, weights and images come from the manufacturers and can change without notice. Colors vary between screens and in the real world. If a detail matters to your decision, ask us to confirm it before you commit. Brand names, logos and product images belong to their owners and appear here because we are a stockist.

4. Deposits, custom builds and special orders

Custom builds and special orders start with a 50% deposit once you approve the spec. The balance is due before collection or dispatch.

  • Your deposit is fully refundable at any time before we place the order with the brand.
  • Once we place that order, the deposit is not refundable, because the frame and parts have been committed to your build.
  • Lead times are estimates, not guarantees. Delays at the brand are outside our control, and we pass on what we know as soon as we know it.
  • If a bike is ready and remains uncollected for more than 30 days after we tell you, reasonable storage charges may apply. We will tell you the amount before any charge starts.

5. Service and repair

When you leave a bike with us, you confirm you own it or have the owner's permission to authorize work on it.

  • We give you an estimate before we start. If the job turns out to need more than the estimate, we stop and get your approval first.
  • We are not responsible for pre-existing damage, or for the condition of parts already on the bike, including hidden frame damage that only becomes apparent once components are removed. If we spot something unsafe, we will tell you.
  • If you supply your own parts, we will fit them where it is safe to do so, but we cannot warranty parts we did not sell.
  • Our workmanship is covered for 30 days.
  • Bikes left with us for more than 30 days after we tell you the work is finished may incur storage charges, and we may exercise our rights under California law relating to property left for repair and not reclaimed. We will always try to reach you first.

6. Bike fit

A full pro bike fit is included with every new bike we sell, at no charge. It is for the buyer of that bike, has no cash value, and cannot be transferred or exchanged.

Bike fit is a performance and comfort service. It is not medical advice, diagnosis or treatment. If you have pain or an injury, see a qualified medical professional.

7. Physical therapy at the shop

Physical therapy at our address is provided by Dr. Dara, an independent licensed provider running her own practice. Sundays does not provide, supervise or bill for that care, and is not responsible for it. Appointments, records, consent, billing and insurance are handled by her practice directly with you.

8. Group rides and events

Our group rides are free and open, and every rider must sign our waiver before joining. Cycling on public roads carries real risk of injury and death. You ride at your own risk, you are responsible for your own bike being roadworthy, you must wear a helmet, and you must obey all traffic laws. Our rides are not races and are not supported or marshaled. Ride leaders are volunteers, not guides, and following one does not make us responsible for your safety.

9. Assumption of risk

Cycling is inherently risky. Buying a bike, having it serviced, or being fitted by us does not remove that risk. You are responsible for checking your bike before every ride, riding within your ability, and getting anything that feels wrong looked at before you ride again.

10. Warranties

Products carry the warranty offered by their manufacturer, and we manage claims on your behalf. Beyond that, and to the fullest extent permitted by law, we provide this website and its content as is, without warranties of any kind, express or implied. Nothing in these terms limits any right you have under California or federal consumer law that cannot be limited.

11. Limitation of liability

To the fullest extent permitted by law, Sundays is not liable for indirect, incidental, special or consequential losses, including lost earnings, missed events, or loss of use of a bike. Where we are found liable, our total liability is limited to the amount you paid us for the product or service the claim relates to. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify Sundays against claims, losses and costs arising from your misuse of this website, your breach of these terms, or your violation of any law or third party right.

13. Intellectual property

The text, photography, design and code on this website belong to Sundays or our licensors. You may not copy, republish, scrape or use them commercially without our written permission. Manufacturer trademarks and product images remain the property of those brands.

14. What you send us

If you send us photos, reviews, ride reports or build stories, you give us permission to use them in our marketing and on this site, with credit where it applies. Do not send us anything confidential, and do not send us anything that is not yours to share. Please do not send sensitive personal or health information through website forms.

15. Acceptable use

Do not use this website to break the law, to harass anyone, to introduce malware, to scrape our content at scale, or to interfere with how the site works for other people.

16. Privacy

How we handle your information is set out in our Privacy policy, which forms part of these terms.

17. Changes to these terms

We may update these terms from time to time. The version published here when you place a request or authorize work is the one that applies to it.

18. Governing law

These terms are governed by the laws of the State of California. Any dispute will be handled by the state or federal courts located in Los Angeles County, California, and you and we both agree to that venue. If any part of these terms is found unenforceable, the rest still applies.
